In terms of residence and citizenship for foreign people, the Government of Paraguay worked hard.
The President of Paraguay Mario Benitez is deciding whether promulgate or not a possible decree, that if it were approved by the Parliament, would also allow the civil judges of the ordinary courts to approve an applying for citizenship by foreign people in possession of their Paraguayan “Cedula” or Identity Card and of all requirements to apply for citizenship. To avoid confusion, we reaffirm that at the time it’s about a Bill discussed by the Chamber of Deputies.
This law was discussed without delay by the Chamber of Deputies. Previously, the Senate had approved the proposal of according to the judges of first instance the possibility of granting citizenship to foreign people in possession of legal requirements.
Later the Chamber of Deputies amended the Bill and the President of the Commission for the Constitutional Affairs rightly pointed out that already in the Great Charter there was the option of granting Paraguayan citizenship to the children of Paraguayan parents born abroad and to all foreign people, who are in compliance with constitutional requirements.
In Parliament, some Deputies expressed concern about the option of entrusting a so difficult judgement to the ordinary judges of first instance. And, in the past, the Court also was perplexed about a Bill, that was intended to allow the judges of the Country to grant citizenship to foreign people by ordinary courts with a very fast timing.
However, the majority of Parliament intends to move definitely towards approval of the Bill and at the moment is waiting approval by the Court in the Parliamentary Committee “Civil Division”.
If the President of Paraguay later approves this law, the Judges of Civil and Commercial Division will be able to grant Paraguayan citizenship to foreign people in possession of legal requirements (Paraguayan Cedula, residence, legal business in Paraguay and good behaviour).
If the Prosecutor does not approve it, the applicant will be promptly informed, so that he will be able to contest the decision. If instead the Prosecutor has no objection, the procedure does not stop, the judge establishes a probative time of three days and after this date he will have thirty days to issue his judgement. If the sentence is favourable, the applicant will be immediately entered in the Register of Civil Status.
Finally, if the applicant is a minor, he/she will be obliged to ratify his/her request in Court, once he/she turns eighteen.
To get Paraguayan citizenship some documents are required and exactly: Identity Card or Passport to confirm your identity, application for residence sent by the Department of Immigration, Criminal Record, degree and professional certification in case of professionals and any other document and graduation that certifies the exercise of a profession, while in case of students you have to bring the School Certificate of Attendance.
